TERMS & CONDITIONS

These Terms and Conditions ("Terms") govern access to and use of the BrigTal Australia’s website, www.brigtal.com, platform, and related services ("Platform"). By accessing or using the Platform, you agree to be legally bound by these Terms.

1. Definitions

  • BrigTal Australia, we, our, us means Neida Enterprises Pty Ltd trading as Brigtal Australia.
  • User means any person using the Platform, including job seekers, employers, recruiters, and visitors.
  • Employer means a business, recruiter, or person posting job listings or accessing candidate information.
  • Job Seeker means a person creating a profile, uploading documents, or applying for positions.
  • Services means all website functions, including but not limited to job listings, candidate profiles, messaging tools, subscription features, and paid services.

Nature of the Platform

BrigTal Australia is an online employment and recruitment platform that connects employers with job seekers.

We provide a digital marketplace only.

BrigTal:

  • does not guarantee employment outcomes
  • does not guarantee candidate suitability
  • does not guarantee employer legitimacy beyond reasonable platform checks
  • is not a party to any employment contract formed between users

Any employment relationship is solely between the employer and the candidate.

User Accounts

Users must provide accurate, current, and complete information.

You are responsible for:

  • maintaining confidentiality of login credentials
  • all activities under your account
  • promptly notifying us of unauthorised access

We may suspend or terminate accounts that:

  • provide false information
  • misuse the platform
  • breach these Terms
  • engage in unlawful conduct

Employer Terms

Employers may:

  • post job advertisements
  • search candidate profiles
  • unlock candidate information
  • communicate with job seekers
  • purchase subscriptions and premium features

Employers must ensure all job advertisements:

  • are genuine and lawful
  • comply with Australian employment laws
  • are non-discriminatory
  • accurately describe the role

Employers must not:

  • post misleading roles
  • collect candidate data for unrelated marketing
  • resell candidate information
  • misuse personal data

Job Seeker Terms

Job seekers may:

  • create profiles
  • upload documents
  • apply for jobs
  • communicate with employers

Job seekers warrant that:

  • all profile information is true
  • uploaded documents are accurate
  • they have the right to share any submitted information

Fees and Payments

Certain services require payment, including but not limited to:

  • subscriptions
  • premium listings
  • candidate unlocks
  • recruiter access tools

Payments are processed securely via Stripe or any other providers.

All fees are:

  • payable in Australian Dollars (AUD)
  • inclusive or exclusive of GST as displayed
  • charged at the time of purchase

Users may cancel subscriptions at any time.

Refund Policy

Brigtal Australia does not offer refunds for change of mind.

Where required by law, refunds, credits, or remedies will be provided.

Intellectual Property

All content on the Platform, including:

  • branding
  • logos
  • text
  • software
  • UI/UX design
  • databases

is the property of Brigtal Australia and protected by Australian intellectual property laws.

Users must not reproduce, copy, distribute, or reverse engineer the Platform without written consent.

Limitation of Liability

To the maximum extent permitted by law, Brigtal Australia is not liable for:

  • indirect loss
  • loss of profits
  • lost employment opportunities
  • hiring decisions
  • conduct of users
  • inaccurate profile data

Our total liability is limited to the amount paid by the user in the previous 12 months.

Termination

We may suspend or terminate access immediately for breach of these Terms.

Termination may occur without refund where the user has materially breached these Terms, subject to applicable law.

Modifications

Brigtal reserves the right to update or modify these Terms from time to time.

Any changes will be effective upon being published on the platform.

Continued use of the platform after such updates constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Western Australia, Australia.

Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Western Australia.
